Terms of Service

By accessing or using AtmoPlayer ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

These terms constitute a legal agreement between you and the creator of AtmoPlayer. Your continued use of the App signifies your acceptance of any updates or modifications to these terms.

Personal Use Only: AtmoPlayer is provided free of charge for personal, non-commercial use only. You may use the App to stream and listen to ambient sounds for your own enjoyment, relaxation, focus, or sleep.

Prohibited Uses: You may NOT:

• Use the App for commercial purposes without explicit written permission
• Redistribute, resell, or sublicense the App or its content
• Extract, download, or copy audio files from the App for any purpose
• Use the App's sounds in commercial productions, videos, podcasts, or other media
• Claim ownership of any content provided by the App

No Rights Granted: Using the App does not grant you any intellectual property rights, ownership claims, or licenses to the sounds, code, or other content within the App.

All sounds available in AtmoPlayer are sourced from third-party providers and are subject to their respective licenses. These sounds are provided for in-app streaming only.

You acknowledge that:

• The sounds are licensed for use within the App only
• You must respect the original licenses of all sound content
• Extracting or downloading sounds may violate these licenses
• The creator of AtmoPlayer is not liable for any misuse of the sounds

For information about sound sources and attributions, please visit the Credits page within the App.

To ensure a quality experience for all users and protect the integrity of the service, you agree NOT to:

• Excessive Usage: Make excessive or abusive requests that strain server resources or bandwidth
• Scraping & Extraction: Use automated tools, scripts, bots, or scrapers to extract content, data, or sounds from the App
• Reverse Engineering: Attempt to decompile, reverse engineer, or discover the source code of the App (note: the App may be open source, but this doesn't permit misuse)
• Impersonation: Impersonate the creator, developers, or any authorized personnel associated with AtmoPlayer
• Malicious Activity: Introduce viruses, malware, or any harmful code that could damage or interfere with the App or other users
• Unauthorized Access: Attempt to gain unauthorized access to any systems, accounts, or data associated with the App
• Terms Violation: Use the App in any way that violates these Terms of Service or applicable laws

Consequences: Violation of these terms may result in immediate termination of your access to the App, without notice or refund (where applicable).

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

This includes, but is not limited to:

• No warranty of merchantability or fitness for a particular purpose
• No guarantee of uninterrupted, timely, secure, or error-free service
• No warranty that defects will be corrected or that the App is free of viruses
• No guarantee of accuracy, reliability, or completeness of content
• No warranty that the App will meet your specific requirements

You use the App entirely at your own risk and discretion.

To the maximum extent permitted by applicable law, the creator of AtmoPlayer shall not be liable for any damages whatsoever arising from your use or inability to use the App.

This includes, but is not limited to:

• Direct, indirect, incidental, or consequential damages
• Loss of data, profits, revenue, or business opportunities
• Personal injury or property damage
• Costs of procurement of substitute services
• Damages arising from viruses, malware, or system failures
• Any claims by third parties

Even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless the creator of AtmoPlayer from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights
• Your violation of applicable laws or regulations

Free Service: AtmoPlayer is provided as a free service. The creator is under no obligation to:

• Maintain, support, or update the App
• Provide customer service or technical support
• Fix bugs or address issues
• Continue operating the service indefinitely
• Provide notice before discontinuing the service

The App may be discontinued at any time without notice or liability.

The creator reserves the right to:

• Modify, suspend, or discontinue the App at any time
• Change, remove, or add features without notice
• Restrict access to certain features or the entire App
• Update these Terms of Service at any time

You are responsible for reviewing these terms periodically. Continued use of the App after changes constitutes acceptance of the modified terms.

All content, features, functionality, design, code, and materials within AtmoPlayer (excluding third-party sounds) are owned by the creator and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works without explicit written permission.

These Terms of Service shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

Any disputes arising from these terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Belgium.

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and the creator of AtmoPlayer regarding your use of the App.
